Terms of Service

These Terms of Service ("Terms") govern your use of CompetiView, operated by Vurtas RF Solutions, a California sole proprietorship ("CompetiView," "we," "us," or "our"). By creating an account, purchasing a subscription, or using the service, you agree to these Terms and acknowledge our Privacy Policy.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use CompetiView. You must provide accurate account information, protect your password, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account.

The service

CompetiView is a competitor-monitoring and listing-visibility tool for online sellers. It may provide public listing information, comparisons, keyword observations, alerts, price-positioning notes, search positions, and historical information. CompetiView is not affiliated with, endorsed by, or sponsored by eBay Inc.

Acceptable use

You may not:

• use the service unlawfully, deceptively, or to infringe another person's rights;
• attempt to bypass account, plan, rate, access, or security restrictions;
• interfere with the service or introduce malicious code;
• use automated means to create accounts or overload the service;
• reverse engineer the service except where applicable law expressly permits it; or
• resell or commercially redistribute the service without written permission.

Subscriptions and billing

Paid subscriptions are processed by Stripe and renew monthly until canceled. You authorize recurring charges at the price shown when you subscribe, plus applicable taxes. You may cancel through the Stripe billing portal. Cancellation takes effect at the end of the current paid billing period, and access to paid features continues until then.

Payments are non-refundable and are not prorated, except where required by law or for verified billing errors. We may change future subscription prices by providing reasonable advance notice; price changes do not affect an already-paid billing period.

Third-party services and data

CompetiView depends on third-party services such as eBay, Stripe, email providers, and hosting providers. Their availability, data, and terms are outside our control. You are responsible for the listing URLs you submit and for complying with applicable marketplace rules and third-party terms.

Accuracy and results

Listing data may be delayed, incomplete, or inaccurate and should be checked against the source marketplace and displayed timestamps. CompetiView provides informational tools, not financial, legal, tax, or business advice. We do not guarantee sales, rankings, visibility, competitive position, pricing outcomes, alert delivery, or uninterrupted availability.

Our intellectual property

CompetiView and its software, design, branding, and original content are owned by Vurtas RF Solutions or its licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your internal business purposes. Public marketplace content remains subject to the rights of its respective owners.

Suspension and termination

We may suspend or terminate access when reasonably necessary to address nonpayment, abuse, security risk, legal requirements, or violations of these Terms. You may stop using the service or delete your account at any time. Account deletion and backup retention are described in the Privacy Policy.

Disclaimers

To the maximum extent permitted by law, CompetiView is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, Vurtas RF Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, or opportunities arising from the service. Our total liability for claims relating to the service will not exceed the greater of the amount you paid to CompetiView during the 12 months before the event giving rise to the claim or 100 US dollars. These limits do not apply where prohibited by law.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought in a court of competent jurisdiction in California, except where applicable consumer law requires otherwise.

Changes

We may update these Terms as the service changes. We will post revised Terms with a new effective date and provide additional notice when appropriate. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
